Is it really illegal to marry liquor bottles?

I am a bartender in south florida and was told that it is illegal to combine liquor bottles. Let's say one bottle is almost gone and you want to pour it into another bottle to save room, when it is the exact same liquor. Is this really illegal? If so, where can I find proof?

This is actually covered by a federal law, as well. But, if you think about it, it makes sense why marrying ANY bottles of liquor would be illegal. It protects from fraud, for one thing. You may think that marrying two bottles of the same brand of cheap well liquor is not big deal. But putting cheap liquor into an expensive premium brand bottle is a huge deception, no? Well, if you wanted to stop this from happening, could you tell just by tasting if a cheap booze had been put into a premium bottle? How could you know? You can't make "but" clauses into regulations like this and tell people that is is OK if it's the same liquor. Because that could be cheated so easily...most people could never tell. It'd be a money making machine. Therefore, the laws are very concrete..you cannot marry bottles of liquor, or refill liquor bottles. Of course there are tax reasons, etc. but as a consumer, you should be thankful for these concrete regulations. Call drinks are more expensive and without such laws you could often be paying extra for cheap crap. Sometimes you probably are anyway.

it could be seen as adulterating (altering or watering down) the liquor. Even if you are doing it innocently with the same exact liquor it's just not a practice you want to get into.

in california it is completely illegal..could result in major fine to bar and bartender fine can include bar closure for up to 15 days. here's the actual fla. law



565.11 Refilling liquor bottles; misrepresentation; penalty.--Any person who shall reuse or refill with distilled spirituous liquors for the purpose of sale a bottle or other container which has once been used to contain spirituous liquors, or any person who shall willfully misrepresent or permit to be misrepresented the brand of distilled spirits being sold or offered for sale in or from any bottles or containers, shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083 and, when such person is licensed under this law, be subject to have his or her license revoked by the division. The possession of such a refilled or a mislabeled bottle or other container of spirituous liquors shall be prima facie evidence of the violation of this section.

It is in Oregon. A bartender can not marry liquor bottles.

I just completed bartending school, and in the alcohol awareness class we were taught that it is illegal in all 50 states to marry liquor bottles. If this link works you will see proof for your state of Florida:

It is Illegal because you could technically put cheaper alcohol in a top shelf bottle thus cheating the customer, and ruining the integrity of the top shelf brand.

well, i have personally never been in love with a liquor bottle and would not want to marry one, but, some people with REALLY special needs might just have that temptation and urge to. you should talk to a lawyer about this. it is not normal....... (JK!)
